General information

<div>These sales terms and conditions apply to purchases of the goods from the webshop. The goods can be only bought from the webshop by the members of Club One loyal customer programme of AS Tallink Grupp. The persons who are not the members of Club One loyal customer programme can register themselves prior to making the purchase as the members of Club One loyal customer programme, based on which they can complete the registration of their order and pay for the purchase.</div><div><br></div><div>All unpaid orders will be cancelled after 24 h of placing the order.</div><div><br></div><div>The sales terms and conditions regulate the legal relations incurring between AS Tallink Duty Free (hereinafter the seller) &nbsp;and physical person (hereinafter the Client) when buying goods from the webshop. The seller has the right to unilaterally change and complete the sales conditions, by publishing the new sales terms and conditions on the website <a href="http://shopping.tallink.com">shopping.tallink.com</a>.</div><div><br></div><div>The client can save, print and, if required, re-submit the sales terms and conditions prior to making the purchase.</div><div><br></div><div>By confirming the order of the webshop the client agrees with the sales terms and conditions.</div>

Validity of the sales contract and product information

<div>The prices of the goods sold in webshop have been displayed by the goods. The delivery cost of the goods is added to the price (hereinafter the shipping cost).</div><div>The shipping cost depends on the shipping method and destination of the chosen goods. The shipping cost is displayed upon placing the order before confirming the purchase and paying for the purchase. The product information is displayed adjacent to the product in the webshop.&nbsp;</div><div><br></div><div>All prices of the goods provided on the website include the value-added tax of transport valid in the country of destination. The shipping cost is added to the total price of the products according to the shipping method of the goods chosen by the client. If the order has been placed before changing the prices or conditions of the webshop, the prices valid at the time of making the purchase transaction are valid. The prices are valid for 24 hours from placing the order.</div>

Price information

<div>Add the desired products to your shopping basket for order. Fill in all required fields and choose the suitable shipping method – parcel terminal, post office or transport to the destination (address) indicated by the client. After that the total cost of the order is displayed on the screen which can be paid for through bank link or credit card.</div><div><br></div><div>The contract enters into force at the moment the payable amount is received to the bank account of the webshop.</div><div><br></div><div>If we cannot deliver the ordered goods due to stock having run out or for any other reason, the client will be notified as soon as possible and the money paid (including the shipping cost) will be refunded within 14 days from the occurrence of the relevant situation.</div><div><br></div><div>The orders submitted in the webshop are processed by the seller on workdays from 09.00 up to 17.00.</div>

Placing an order

<div>Goods are shipped to Estonia, Finland, Sweden, Latvia and Lithuania. Goods are sent by the seller either to the parcel terminals, post office or are delivered to the client to the address chosen by it.</div><div><br></div><div>The seller completes the ordered goods for fulfilment of the order and forwards it for shipping to Tallink Takso,&nbsp; Itella Estonia OÜ, DPD Eesti OÜ, Omniva OÜ, Boomerang Distribution OÜ, Instabox or DHL.</div><div><br></div><div>The ordered goods reaches in general the destination set by the client within 2-7 workdays after the enforcement of the sales contract, i.e. from the date the amount subject to payment for the order has been received to the bank account of the webshop.</div><div><br></div><div>The seller has the right to deliver the goods in exceptional cases within up to 45 days which is notified to the client by e-mail.</div><div><br></div><div>If the ordered parcel of goods reaches the parcel terminal, the SMS message including the door code of the parcel terminal is sent to the mobile phone number provided in the order. The door code should be inserted to the parcel terminal, thereafter the door of the terminal including the goods parcel opens. The package can be fetched within 7 days from its reaching the parcel terminal.</div><div><br></div><div>If the ordered parcel reaches post office, the SMS-message including the barcode of the parcel is sent to the mobile phone number provided in the order. To receive the parcel the personal identity document and the barcode of the parcel received by SMS should be submitted in the post office. The parcel can be fetched within 7 days from its arrival to the post office.</div>

Shipment of goods 

<div>Pursuant to the receipt of the parcel the client has the right to withdraw from the contract concluded with the webshop within 14 days. If the client has damaged the goods to be returned intentionally or due to negligence, the seller has the right to refuse from taking the goods back or require the compensation of the damage caused.</div><div><br></div><div>To exercise the 14-day right of withdrawal the client cannot use the ordered goods in some other way than in the way which is needed for the control of nature, properties and functions of the goods so as it were allowed in the actual shop. If the goods are used for some other purpose than for the control of nature, properties and functions of the goods or if there are signs of the normal wear of the goods, the webshop has the right to decrease the amount to be returned according to the decrease in value of goods.</div><div><br></div><div>To return the goods, you should send the declaration of withdrawal to the seller by e-mail (the form is available here: declaration of withdrawal) within 14 days from the receipt of the goods.</div><div><br></div><div>The client covers the expenses related to the returning of the goods, unless the reason of returning is the fact that the product to be returned is not compliant with the order (e.g. incorrect or defective product).</div><div><br></div><div>The client should return the goods within 14 days after having made the declaration of withdrawal or submit the certificate that it gave the goods over to the carrier within this period.</div><div><br></div><div>At the receipt of the returned goods the webshop returns all fees received on the basis of the contract from the client immediately, but not later than within 14 days.</div><div><br></div><div>The webshop has the right to refuse from making the repayment before the receipt of all goods to be returned or before, if the client submits a certificate on the returning of the goods – depending on which takes place before.</div><div><br></div><div>If the client has chosen other shipping method than the cheapest usual shipping method offered by the webshop for returning the goods, the seller is not obliged to compensate the amount exceeding the usual shipping fee to the client.&nbsp;</div><div><br></div><div>The webshop has the right to withdraw from the sale and require the returning of the goods from the client, if the price of the goods in webshop has been indicated considerably below the market price due to error.</div>

Right of withdrawal from the contract 

<div>The webshop is responsible for the non-compliance of the goods sold to the client with the terms and conditions of the contract or for deficiencies which already existed at the time of delivery and which occur within two years of delivering the goods to the client. If the defective goods are exchanged by webshop, a new two year period will begin. </div><div><br></div><div>It is assumed within the first six months after the delivery of the goods that the defect was existent at the time of delivery of the goods. It is the responsibility of the webshop to prove otherwise.</div><div><br></div><div>The client has the right to notify the webshop of the discovery of the non-compliance of the goods within two months from its discovery by e-mail or phone and submit the pretension. The webshop is not liable for the defects occurring for the goods after the delivery of the goods to the client.</div><div><br></div><div>If the goods bought from the webshop have defects which are the responsibility of the webshop, the latter repairs or replaces such goods. If goods could not be repaired or replaced, the webshop returns all payments resulting from the sales contract to the client.</div><div><br></div><div>The webshop answers to the complaint of the client in writing or in the format enabling the written reproduction within 15 days from the receipt of the complaint from the client.</div><div><br></div><div>The seller is not liable for the losses or delays caused by force majeure circumstances and which could not be foreseen.</div>

Defective goods

<div>The seller uses only the personal data entered by the customer in the Club One customer program database (name, telephone number, address, e-mail, bank account number and Club One card number) to process the order and send the goods to the customer, ie to fulfill the contract and, if necessary, contact him.</div><div><br></div><div>In order to serve the customer and perform the contract, the Seller may disclose the customer's personal data to a third party who provides services to the Seller and is contractually obliged to keep the shared information confidential. The third party is, for example, the companies of the AS Tallink Grupp group and the Seller's partner Boomerang Distribution OÜ, whose tasks are the transport of the goods sold by the Seller.</div><div><br></div><div>The collection of personal data of registered customers (regular customers) may take place upon submission of contact data (incl. Name, personal identification code, postal address, telephone number, e-mail address, preferred method of contact) on the Seller's website or elsewhere (eg in stores or representative offices); when using the website from the customer's account information or through cookies, if cookies are used; when making a purchase or order, storing a person's contact information or information concerning purchasing preferences at the Seller's sales points or websites.</div><div>&nbsp;</div><div>The seller is obliged to protect the personal data of customers and to process them in accordance with the legislation.
